Leasehold versus Freehold

People in the freedom community generally are motivated to be owners of their own homes, masters of their own destinies. However, the method by which actual ownership is typically manifested is through the mechanism of subdivision and freehold.

What does that mean? In practice, it means that a property owner or owners either sell their land to, or work closely with, a real estate developer. The land is planned for streets, home sites, and amenities. Then the earth moving begins. In subsequent months as streets go in and lots are graded and provided with utilities, home builders buy these lots, build finished homes and sell them to home owners.

Often built into the mix are certain common facilities, such as a club house, golf course, community swimming pool, horse stables, bridle paths, drainage ponds, and the aforementioned streets connecting the lots to the world outside. As with all commons, there is the prospect of tragic results.

To limit the difficulties in some ways, at the cost of increasing them in others, the typical real estate development company establishes a home owners association (HOA). This outfit then manages the administration of deed restrictions and covenants, may impose rules for the neighbourhood about cutting lawns, not growing food plants in the front yard, leashing pets, and on and on.

Suddenly, in the search for home ownership and destiny mastery, the freedom enthusiast finds a whole new level of government has been created. Homeowners associations collect fees, employ enforcement agents, hold meetings to object to all manner of trivial activities, come up with new rules, and establish a bureaucracy that lasts forever. Enforcement of association rules can be political and capricious, and enforcement agents – the most notorious example being the BTK Killer – can be violently dangerous to the home owners themselves.

Notwithstanding that the streets were built privately by the real estate developer, and might be managed by the new homeowners association, it is typically the case that the streets are turned over to city or county government for further mismanagement and additional levels of bureaucracy. Perhaps the homeowners retain control over some service, such as garbage collection, but this control may be removed from their control by city or county ordinance or by state law in order to satiate the political interests of a labour union or to fulfil actual bribes of county commissioners by a particular garbage collection company.

Worse, instead of decentralising their approach to providing water, sewer, power, and other utilities, the real estate developer typically contracts with established utility monopolies. Costs increase, choices diminish, and homeowners have additional burdens. Instead of a resilient community with many water sources, local treatment of sewage for useful fertilisers, and distributed power generation, everything is forced into a rigid and centralised system. As with all centralisation, the resulting system is more fragile. Your home’s roof could provide significant solar power, your land may have a natural gas field not far below the surface, but one transformer failure and the power line to your home goes dead, and you suffer in the heat or cold.

Is it possible for it to get any worse? Yes! The entire conception of the real estate development, as a subdivision of homes or as a shopping city, or for some other purpose, represents the land use vision of the real estate developer prior to the time the development begins. Land use requirements may change, and the vanishing economic interest of the real estate developer, who has sold off the various home sites and left a home owners association in charge of the remaining commons, includes no ongoing examination of the economic possibilities of the area. Responding to new economic conditions by changing the land use pattern may be prohibitively expensive, requiring the buying out of all of the land owners in order to consolidate their various deeds and then nullify the deed restrictions.

To “address” the matter of land redevelopment, the authoritarians have a concept called “eminent domain” which compels supposedly free land owners who are allegedly masters of their destiny under the subdivision and freehold model to sell their land. In a recent case in Connecticut (Kelo v City of New London) it was determined by the United States supreme court that the momentary economic interests of a redevelopment scheme are sufficient to justify the forced sale and coerced relocation of all land owners. No one with any sense of reality could call the existing system peaceful, just, nor freedom oriented.

The 999 Year Lease

When I first got involved in real estate development in Texas, the above model was very close to the exact approach taken by the real estate developers with whom I worked. The finished value of the homes on the hundreds of acres developed by Ayrshire and by Altair real estate development companies is now in the billions of dollars, and by all signs the home owners are reasonably happy with their communities, including amenities such as lakes, community centres, swimming pools, wooded hiking paths, golf courses, fountains, plazas and so forth. The subdivision and freehold model has many adherents and represents a profitable, economically viable path. It is not, however, the only way.

My introduction to the alternative paths forward came from my work with Michael van Notten and his colleague Spencer MacCallum. Michael and I worked from 1995 until his passing in 2002 on projects in East Africa involving the prospective development of a free port, a toll road, a fishing fleet, educational facilities, utilities, and homes. Spencer presented the many arguments in favour of long term leasing, where ownership of the land would never be subdivided.

As it happens, that approach was culturally consistent with the Somali traditions about land. In their pastoral and nomadic culture, land territory is held as a clan property, not belonging to an individual family. Our proposals to not purchase land but to lease land and only take possession of the fruits of its use (its usufruct) were very agreeable to the elders of one of the clans. Other geopolitical and historical events interfered with our ability to pursue those plans in that region. My interest in leasehold as a path to build successful freedom communities remains very strong.

During my work with Michael, he suggested that I look into the 999-year leases that had recently been renewed in London and in Amsterdam, among other places. It seems amazing that a business arrangement could last for a thousand years, and work so well that both landlord and tenant would want to get started on another millennium of working together. Obviously, the heirs and assigns of the original landlords and those of the original tenants were involved in the renewals. Perhaps in the future with longevity treatments, a person may individually live to renew such a long term lease. Meanwhile, it speaks to the multi-generational stability of the approach that such leases have been renewed.

The concept of leasehold leaves the common areas and nearby properties in other hands. A person might lease a home, or a business might lease a building, with the landlord taking ongoing responsibility for community features such as roads, a hospital, community defence against crime or invasion, and any other amenity one might name. Private judicial and dispute settlement services might be identified in the lease agreement and be parts of competitive industries in these areas. Land use would continue to be embodied in the property interests of property owners rather than in the expedient or corrupt political interests of politicians, bureau-rats, or influential cronies of the government.

Since a large property is kept in the hands of one owner, the governmental trick of changing assessed values and targetting the comparatively helpless individual freeholders is met by more sophisticated and effective responses. Fees for subdivision are avoided. Changing economic conditions can be rapidly met by the land owner with new development, upgrades, or by exercising buy-out provisions in the lease if any such provisions are included. In summary, leasehold has many advantages.

The American Dream

A brief summary of the American dream as it is often imagined might be stated as follows. A hard working individual creates a new business enterprise, builds it up, thrives, and expands the business. Soon he has a large team working with him on greater success. He buys a home, marries, the happy family have children, and all is right with the world. Many very merry Christmases and other holidays ensue.

The actual experiences of Americans vary, of course, but a great many find that their brilliant ideas are thwarted by actively hostile political and economic vested interests. Their business starts boldly but becomes the target for abusive lawsuits, false arrests, active persecution, and it is soon gone. Or their business grows for a few years or decades and then the health inspector demands a payoff, followed by the fire chief, followed by a visit from the patrolmen’s union. Soon, all the profit is going to paying off corrupt officials, the business barely gets by, and a crisis occurs forcing it to close.

The home that was purchased is lovely until a nasty neighbour moves in next door. Then gardens are poisoned, attack dogs threaten viciousness, junk cars appear on the street, drug sales commence, violence is threatened, and happiness is gone. Or a new homeowner’s association official persuades the association to greater fees and more regulatory impositions at a sparsely attended meeting with carefully chosen members. Soon a host of officers has arisen to eat out the substance of the home “owners” who become owners-in-name-only. Or a national emergency is declared, tyrants abound, and nobody can walk down the street without wearing a masque (to be part of the masquerade), small businesses are shuttered, big businesses are the only ones allowed to operate, a national coin shortage forces a switch to a “cashless” society with social credit scores, and dissidents begin to be liquidated.

Relying on government to keep things safe has proven to be a terrible idea. Safety is an illusion, and people are not safe in their communities, especially when corrupt government officials and bureau-rats are involved. Nor are the schools any good. The happy children that went to a few hours a day of schooling fifty years ago are now miserable drudges forced to be repeatedly vaccinated to profit a cartel of pharmaceutical companies, taught by Marxist teachers whose union prevents all creativity from flourishing, and bullied by not only the system of “education” itself but also by other children who are encouraged to bully their peers. Fighting back is punished. Everyone is miserable. Public schools, like all other aspects of the commons, don’t work.

The nightmare of 2020 is the result of continual bad choice taking. Instead of keeping their own power and individual sovereignty, Americans have been encouraged to trust untrustworthy teachers with their children, untrustworthy police with their safety, corrupt fire officials with fire fighting, corrupt sanitation bureau-rats with garbage collection and street cleaning, corrupt water and sewer officials with fresh water in their homes now tainted with many additives, occasional scandals of lead pipes further polluting their water, and all kinds of scams involving how drainage is arranged and for whom. In sum, the American dream is corrupt to its very core.

Failing Cities

Cities have failed to provide good results. Deed restrictions and zoning do not work for the benefit of home owners long term. Corruption and abuses of power are built into the concentration of power. Centralised systems are fragile and expensive. Misery and tyranny abound.

Instead of being the master of his destiny, the typical American home owner is a serf, commanded by a homeowners association, abused by overseers called police, thwarted by government officials, taxed, licensed, regulated, and further abused by bureau-rats, and subject to arbitrary forced selling through eminent domain. Americans even have a joke about it: You start out as a home owner and very soon you are a home moaner.

An Alternative Strategy

Instead of subdividing a vast tract of land, selling it off to home builders who sell their finished homes to home buyers, all of whom rely upon a homeowner association initially controlled by the real estate developer but soon to descend into the quagmire of parliamentary procedure and pseudo-democracy, all while dancing to the tune of various government agencies, corrupt officials, and busy bodies, what if people chose a different way? What if the large tract of land was kept entirely in the hands of one owner, a company or non-profit or partnership or individual?

Consider a leasehold property owner that has shareholder representation from its tenant lessors. So, when I lease 3 acres for 99 years I get shares of the company I lease from, and therefore have some stockholder rights under equity. If I lease 3 acres for 999 years, maybe I get a few more shares. If I lease 1 acre, fewer shares; 10 acres under lease gets me more shares. So part of the ownership is proportional to the land under lease. Also note that there would be original investors and other shareholders, it would not only be the tenants who own it, or not necessarily.

The various rights of tenants, landlords, users, and visitors would be provided for under a set of agreements. Everyone would know where they stand, how things are in this particular community. As with checking into a hotel, a tenant would have access to credit facilities, amenities, his own particular room or space, and an attentive staff who wants to help the tenant get the most out of the relationship. Satisfied customers result in repeat business, and good reputation spreads, bringing in more customers.

The goal of this strategy is not to upset the existing way of doing things, but to do things in the most effective ways already imagined and implemented in developments in the United States and around the world. None of these individual ideas is very new. Combining these ideas into an effective business will depend not only on the effectiveness of the ideas, but also on the care and courtesy of the managers. Good planning, good strategies, and feedback from customers will guide the successful real estate entrepreneur of the future.

If we are careful and sensible, we can reduce the need for government, free ourselves from servitude, and provide for our posterity a free world. It won’t be trivial or easy. It will take investor capital, hard work, and good leadership. For such a consummation, I devoutly pray, may God’s will be done, amen.

Freedom Land DAO

Over the last twelve years, a great deal of thought has been put into the development of cryptocurrencies like Bitcoin and Ethereum. There are now many thousands of similar currencies. The market has valued them at various levels, and you can look up their “market cap” and other details at sites like if you wish. One of the vitally important concepts to come out of all this thinking is the smart contract, which has led to the development of decentralised structures for finance and for operations.

A simple way of looking at the opportunities thus created is to consider the “ringleader problem.” If there is a rebellion against authority and one or two people are the prominent voices, then the evil wicked authoritarians in government merely have to target those leaders. Take them out by killing them, or discredit them by a campaign of lies and persecution, and before long the rebellion is suppressed. Free people are again thwarted and the mass murdering baby raping cannibals in government and their baby raping cronies in giant multinational corporations are able to continue in power and keep raping, killing, and looting.

Decentralised finance or DeFi is a collection of autonomous enterprises, led by outfits like which provide smart contract systems for reliable lending. An overview here seems worth a look for people new to the ideas. One important take away is that as of two weeks ago, there were over $2 billion of value being lent and earning returns for investors, in various DeFi structures.

Freedom Land

The goal of Freedom Land is to build a large number of communities on land secured by purchase. Each participant in the DAO is paying for a deposit on a long term lease for a home site on one of the properties. We will seek to purchase not less than 40 acres in any given purchase, so that an effective number of freedom enthusiasts are able to live near one another at each project. Once we purchase land, nothing prevents participants or non-participants in the DAO from buying additional land nearby.

Among our goals:

  • Take the high ground;
  • Get rural
  • Have acreage that is agricultural use exempt from property taxes;
  • Develop as participants move;
  • Think strategically

We are not a real estate broker, we are going to be a leasing agency. We will purchase land and lease home sites through a structure such as a real estate investment trust, non-profit organisation, limited liability company, or other company as best suited to the particular jursidiction (nation, province or state, county or region) where we are buying land.

Our DAO will contract with lawyers, accountants, realtors, and other parties to provide strategic relationships with government tax authorities, government regulatory agencies (if any – many rural counties have none), utility services, road contractors (muh roads!), and others to provide long term usability to all DAO participants.

Freedom Land DAO will track the order in which deposits are received. DAO participants will be able to designate rank order preference for location. Once land is purchased, DAO participants will be able to choose whether to locate in that community and choose a particular location within it, first come first served – with off-chain trading possible for people who choose. Space will be set aside for a community centre and roads. You’ll be able to camp on your land as soon as it is purchased. You may buy as many units at each size as you wish, so if you want to have a quarter acre in three different parts of the country or world, we will accommodate you.

Our goal is to provide long term leases on great accommodations for freedom enthusiasts. Based on work the author of this essay performed in 1995-2002 with Spencer MacCallum and Michael van Notten, there are places where 999 year leases have been renewed, meaning that after almost a thousand years of working together, tenants and landlords have decided to go for another thousand years of success.

In his book The Art of Community, author and freedom activist Spencer MacCallum writes about the use of leasehold to keep land together and avoid the difficulties and outrages of homeowner associations; of placing the streets, sewers, street lighting, and other common facilities in the hands of government; and many other problems that the last century of subdivision and freehold have revealed in old-style real estate development. Back in the 1990-1993 period, working with real estate developers in Texas, I was involved in developments with homes now worth on the close order of $600 million or more. So, I know a lot about that approach.

I’m convinced by Spencer’s arguments and the experiences of land developers who have kept large tracts of land undivided that the path to both freedom and profitability is with careful land use planning and leasehold-based communities. For example, a friend in Belize recently told me about an intentional community built on 50,000 acres in that country which has succeeded for many decades already. The general idea is that people who are interested buy into the DAO and contract for a home site (which they can use for purposes of their choosing, within the tenancy agreement which will be forthcoming real soon now).  Their initial payment is a deposit on their home site.  A person can choose to buy into more than one location.  Every year on the anniversary of their deposit payment, their annual lease payment on that home site is due.  For a quarter acre property the goal is that the deposit be about US$1,000 - though given the anticipated hyperinflation that is probably going to be some other number like one-tenth of a bitcoin or 5 ounces of gold or 50 ounces of silver.  Anyway the buy-in should be within reach of a great many people.

With the funds provided from the deposits, land will be purchased and work will begin on the development of the land.  The net present value of the future streams of income from the tenants should allow for significant financing of roads and decentralised utilities (natural gas well on property, solar power, efficient hydroelectric, etc.).  Other amenities and community features (mutual aid, rapid response teams, local clinic) and development of nearby land will be included as the project continues.  Based on Wendy McElroy's excellent review of the work of Josiah Warren, it will be useful for each community to have a community centre, such as a large pavilion or building in which facilities for preparing food and for dining together as a group can be found.  Being able to meet regularly and share food together seems to bring people together and help a community thrive.  Having their own internal or local currency does, too.

So the smart contract facilities involved in Freedom Land DAO will include a list of the things provided to the leaseholders by the developers.  Some of those things would be a community centre, secure perimeter defence including fencing, and access roads.

I am personally interested in land near Newport, Tennessee; Jasper, Georgia; Sittgreaves Forest, Arizona; White Mountains, New Hampshire; Bitterroot Mountains, Idaho; St. James, Missouri; Spavinaw, Oklahoma; and other areas.  I don't think this DAO should focus on only one location, though inevitably the first location will be of great significance to the success of the project.

Progress Thus Far
In the last four days, I've been approached by people and landowners in Belize, Canada, Texas, Georgia, West Virginia, Virginia, Kentucky, Tennessee, Illinois, Kansas, as elsewhere about opportunities and possibilities.  There are going to be many of these project locations.  

The largest one is close to Alpine, Texas and is at least 320 acres.  A small one, 40 acres, is located in Belize.  

I've told enough people that the ideas involved will be implemented by other people, too, and I'm very happy about that.  When it is railroad time, you see lots of people building railroads.  Competition makes a free market huge, and there are 150 million freedom enthusiasts in America who need to have good communities and happy homes - far more than any one business can serve.  

There are also more gatherings.  This weekend and through 10 August Jackelope freedom festival is in Arizona.  The weekend of 24 to 27 September is happening in Naturita, Colorado where there are people planning to pursue a sovereign community strategy.  The weekend of 10 October is and the following weekend Luau East will be in eastern Kentucky.  The weekend of 24 October will see a Georgia event. Lending to Kroger

A few days ago, I went to Kroger. The register at checkout indicated that I owed $10.15. So, I presented eleven dollars in cash.

The clerk announced, “Due to the national coin shortage we cannot provide you with change. If you wish, I can put the change on your Kroger loyalty card.”

Checking my pocket for spare change, and finding only a handful of pennies, I looked at the cashier and said, “So, Kroger is borrowing 85 cents from me? I guess they’re good for it. Seems odd though.”

The clerk replied, “It really is odd, yes.”

So I think to myself, “I wonder how much they stand to make from this zero interest compulsory lending scheme?”

Turns out their 2019 revenues were $129 billion or so. Hmmm. If 10% of transactions were for cash, which may be low, I don’t really know, then $12.9 billion would be offered in a calendar year for cash. Let’s guess the average transaction is $129, which seems high. And let’s guess the change (some will have exact change, of course) were averaging only 35 cents per transaction. So, the public fork over $35,000,000 for up to a week or longer before their “change” can be applied to their next purchase.

Pretty nifty scam for the big box stores. Banks are also posting signs on their doors to the effect that they won’t provide coins.

1792 Mint Act

A favourite of mine is the 1792 mint act which actually says that any government official who causes the mint to emit coins of less silver, gold, or copper content than specified in that law may be sentenced to death. The constitution says that “no state may make any thing but gold and silver coins a tender in payment of debt.” You can look these things up yourself, and then you might be persuaded that they really say those words. I’m sick of coddling people who want a link to everything. Learn to use a search tool like DuckDuckGo (which doesn’t track your searches and never sells your data to governments). Or suffer in ignorance, as you prefer.

Now, in 1965, the evil filthy mass murdering dictator who overthrew JFK in a bloody coup in Dallas said that “silver is too expensive to be used as money,” and took the silver out of the money. In 1983, the copper was taken out of the penny. So, they have been counterfeiting the coins for quite a while. But they have not forgotten how.

They have, however, decided to track your purchases. So they will do so, and if you don’t like it, too bad. A cashless society is here, brought to you by the communists of the international banking cartel and the fascist cronies of the big box stores. You don’t get a choice.


Why are they tracking your purchases? So they can find out whether you’ve been naughty or nice. So they can keep up on how much ammo you’ve bought, and how many household chemicals, and also whether you buy things for your family when they are in hospital or have birthdays. The deep state wants to impose a social credit score.

I will say that Doktor Fauci has proven to be a very unreliable person with regard to truth, health, or safety. Yet, Trump continues to back everything Fauci wants.

I believe that’s because Trump wants to see the vaccines mandated, and looks at the trillions of dollars to be spent on them, worldwide, with their monthly updates, by governments on behalf of billions of people, and salivates about becoming the first trillionaire. Today in Colorado

Today a friend in Colorado reports that the communist dictator posing as governor has decreed that everyone must wear a masque. A fine against retailers that allow people to enter without masques of up to $10,000 per incident is the stick. There is no carrot.

There is no scientific evidence, at all, that masques save lives. There is no evidence that any masque can stop any disease.

Some months back, I replenished my preps and bought a box of surgical masques. On the box the label clearly says that it does not stop any disease. It cannot. None of these masques are sufficient for preventing virus particles from reaching the airways, and none of them protect the eyes, ears, or other bodily openings into which the virus might pass. As recently as February the communist Centres for Disease Control announced that masques were not useful, and warned against trying to buy them. Since that time, people in jobs in construction have found many kinds of masques unavailable at the hardware stores. So, they are inhaling a lot of particles and fumes that they might be able to protect from, if only.

Long Ago in Germany

The argument made in Europe in the Middle Ages and again in Germany under the Nazi regime was that there were public health consequences for allowing Jewish people to be in public without some obvious indication of their ethnic and religious heritage. There was a yellow badge, a Star of David, that was to be worn by all Jewish people.

People who would not wear the badge were publicly humiliated, beaten by other people on the streets, shoved into the gutter, or killed. That’s happening now. People are reporting their neighbours for not wearing masques, refusing entry to stores and restaurants, and in one recent incident in Ontario, a man was killed for trying to enter a grocery store without a masque.

(The thin blue line crowd will insist that he struggled and resisted and fought back and that if he had only obeyed, he would be alive. The Nuremberg trials revealed that it is no defence to impose an immoral order just because you were following someone else’s order. But thin blue line pig lovers are boot licking filth. Come at me.)

So, here we are, America. You must wear a masque. If you don’t, you will be taken away. In Arkansas, they are using military escort to take people to quarantine, according to a recent news story.

If you aren’t going to ever doing anything to remain free, then you won’t.

Places to Go, Things to Do, People to Be

Once again a small number of evil people have determined to enslave the rest of mankind. Good people are ready to oppose tyranny. You have an opportunity to meet some of them at events coming to you soon.

Freedom is demonstrably, provably better than slavery. Freedom is better than tyranny, and, again, this can be proven. Logic, economics, health, conservation of natural resources, and inventiveness all support these conclusions. We are better off when we delegate fewer powers to others, keep our own original sovereignty, and build for a better tomorrow.

These conclusions became so clear by the 1970s that the postmodernist movement was founded to attempt to strip away logic, reason, and standards of accomplishment in the pretence that the undesirable, unwanted, hateful, and evil ways of authoritarian governments should be accepted even though they are clearly no good at all. The 262 million dead in government genocides and the 55 million dead in wars stand in mute testimony to the depth of evil involved in state authority.

Thousands of years ago, Jesus said that a wise man builds his home upon a rock. Rains, floods, and winds come and beat upon that house and it stands. A foolish man builds upon the shifting sands of expedience. All political systems, all authoritarian strategies are built upon sand. All of them fail. And, in failing, all such systems bring about misery for millions or billions of people. I invite you to put on the greatness you have within you, and be who you need to be to win freedom for yourself and your family.

If you want to rule yourself, if you want to work with other sovereign free people to build free communities, to engage in trade and commerce, to advance the cause of freedom, to get to the amazing future that awaits, you should find other people who think as you do. You can cooperate with them voluntarily to make our world better, for fun and for profit.

You won’t find anyone at in Las Vegas later this month. It has been cancelled by tyrannical decree of the governor of Nevada. However, an emergency meeting of freedom enthusiasts is being organised, and will take place, so watch that page for details.

You can find some free people at the Jackelope Freedom Festival in the Sittgreaves National Forest in Arizona (near Heber Overgaard) in the first two weeks of August 2020. I attended in 2018 and 2019, and there are many good people there. I’ve not made arrangements to attend this year, but I’m willing to do so if I can find sponsors for that purpose.

Our work is in response to the recent concerns about large scale meat processors. Many ranchers here have been told that they may not be able to sell their herds due to the Corona Virus affecting the meat processing industry. Rather than destroy their herds, the ranchers have joined together with local butchers to make this new project happen. Bedrock Beef is about helping customers buy the beef they want and helping ranchers get their cattle to market.

Energy isn’t just about calories and nutrition, sometimes it’s about just that; energy. When you eat livestock, you are getting two types of energy- both caloric as well energetic. The Crime Recorder

Americans are currently faced with the fact that the people who police them are willing to murder them in broad daylight. The ideas that police should be an occupying military force within the cities, that they should be a source of fear and terror among the people, and that they should enforce violently various statutes that include a dizzying array of non-violent but prohibited behaviours seem, to me and many others, to be ideas that are completely inconsistent with a free people and a free country.

Leaving aside as irrelevant all the defences that are typically mounted about how the police are a thin blue line (690,000 law enforcement in a country of 332 million) and that there is a war on the police anyway so of course they must be garbed for war and deliberately brutal, and the always flavourful “if you don’t like the laws get them changed” let’s look at what functions the police have been doing that we may wish to see done.

No, seriously, it is totally okay if you wish to debate the merits of police agencies shooting and killing 1,004 Americans in 2019 and killing more in other ways. You are welcome to explain all about the essentials of police brutality, and when you get done, please go on to explain why overseers whipped slaves. Also, if you wish, please go over the vast array of thousands of laws and regulations Americans are expected to obey, the need for prison sentences for non-violent crimes, and do let me know why you believe Ross Ulbricht is serving two consecutive life sentences and forty years for building a free market web site. Then you can go around to all 2.5 million Americans in prison, all 3.8 million on probation, and the million or so on parole who are all expected to be watched and pay fees and obey endless more rules. If you don’t believe there is a prison and probation for profit industry, you may be beyond help.

Police Reports

If the police ceased to exist today, what functions they perform would be needed? One example is the police report that insurance companies insist must be made available to them in the event of a crime or tort. If someone hits your car or breaks into your home or in some other way does damage to you physically or economically and you plan to file a claim against your insurance, your insurance company may make the seemingly-reasonable request that the police be summoned to make a report.

Now, summoning the police has been fraught with peril for the entire time since 1829 when Sir Bobby Peel formed “the bobbies” or the Metropolitan police force in London, one of the first police agencies inflicted on contemporary society. Calling the police can mean that people you know get arrested, things you own get stolen by the police, people get beaten, men or women get raped, dogs get shot, and fairly often, someone gets murdered. Is it possible there may be another way?

Recently I was reading The Fourth Protocol by Frederick Forsyth which includes a scene of a group of skinheads beating a Russian sailor unconscious a few miles from the docks in Glasgow. Two “police constables” arrive on the scene, summon help, an ambulance takes the sailor to hospital. One constable is going through the worldly possessions of the sailor when he wakes up, sees his stuff being pawed at, makes a grab for some of it, then, perhaps disoriented from his recent concussion, runs through the hospital, upstairs, and eventually throws himself from the roof of the building. Combined with recent events in American cities, this sequence of events in the book got me thinking.

What if there were people who provided “crime recorder” services? They need not be employed by government. They would need to be trained and have some sort of mutual certification procedure. Various guilds and trades have always spoken for members of their own profession and held them to standards, so the certification need not be governmental.

The function of the crime recorder is to make a detailed record of what is reported by the victim or victims, what is reported by available witnesses, what the crime scene looks like, and collect materials that may be relevant. A crime scene investigator is a similar profession.

Of course, today’s crime scene investigators work for police agencies and city governments and therefore are prone to hide exculpatory evidence when ordered to do so, and lie about what they’ve actually seen when it comes time to confront a police officer with wrongdoing. The process is called “testilying.” Yes, police have a special word they use, “testi-lie” to describe lies told for the good of the police union, the good of the gang in blue. They like to lie about what has happened, in order to complete the process they favour: the police investigated the police and exonerated the police.

Nevertheless, you can see where a crime recorder could provide a useful service. A crime report would be akin to the police report we now obtain by taking the dangerous step of summoning the police. A crime recorder would provide a record and a written report, making available photographs, videos, audio recordings, witness statements, and perhaps collecting physical evidence where relevant. A crime recorder could also make reports on suspected torts – acts of negligence such as auto accidents.

Crime recorders would not need to be in uniform, but perhaps they would have a sigil or badge of their profession. They would not necessarily have an IQ below 105, or whatever standard is kept presently for police officers. (A recent court case showed that a police agency may discriminate against someone with an IQ of 125. Apparently the “average” is 104, so slightly above the population average of 100 IQ.) A crime recorder would not necessarily work for the government. A crime recorder might not belong to a public service union and might not be expected to support the police in all matters. It would be possible to have independent and competing crime recorders working to find the truth.

Truth Matters

It seems to me that the first victim in every war, including the ongoing wars against poverty, crime, terror, and drugs, is truth. Yet the truth is very important.

Prosecutors like Kamala Harris cannot be interested in the truth, because the truth may stand in the way of convictions. Prosecutors get more money if they get more convictions and they get higher offices if they get more convictions, so they have no interest in telling the truth, nor in presenting the truth in court. They especially don’t want defence attorneys to ever know the truth. Prosecutors get a share of the profits from keeping a lot of people in prisons, forcing their relatives to pay for collect calls from prison (at absurd rates per minute for each call when flat rate “anywhere in America” calling plans are available for $25/month) and putting them on a “pay the state for years” programme. Prosecutors, in short, are evil.

Public defenders are only somewhat interested in the truth. If they are able to fumble around and discover the truth on behalf of one of their court-appointed clients, great. If not, they are quite adept at encouraging their clients to plea bargain so that the prison and probation for profit industry is fed another living victim. Public defenders are not good at locating the truth, and often are not provided much in the way of investigation time nor investigatory staff. Of course, prosecutors are provided not only with endless time to investigate – they can ask for and get a continuance quite easily from any court – but they are also provided with numerous investigators, coroners who will fake evidence or lie about findings, detectives, police officers, and bureau-rats who will either look for information or make it up out of whole cloth. So, of course the system convicts most people it arrests, or gets the public defender to plea bargain their client, or makes it very expensive for a person to prove they are not guilty. The system doesn’t actually care about the truth.

But a crime recorder wouldn’t be involved in all those aspects of the situation, and could be prevented from sharing in the profits of the prison and probation for profit industry. So, perhaps the concept of a crime recorder is worth considering.

Goodness knows, it would be wonderful if finding the truth were important to someone in the criminal justice industry. If the truth were sought, perhaps it would begin to resemble something like justice, and stop being so clearly a “just us” system where those in power are corrupt beneficiaries of their system, and everyone else is a potential victim.

What Is the Igloo Luau?

The Igloo Luau is an event being organised for late September. We feel that people in the Free Mountain West should have a gathering, a festival, and a time for enjoying the traditional activities and crafts and foods of the Rocky Mountains. Our festival will include musical acts, speakers, presentations of crafts, and contests. Our goal is to bring people together in celebration of freedom, free markets, and the opportunities and possibilities of working together toward a better future.

Why Have a Luau?

The tradtional lifestyle of the people of Hawai’i did not allow men and women to eat together. However, in 1819, King Kamehameha II removed all the religious prohibitions and in an act of great symbolism ate a meal with women. Since then the luau has been a traditional Hawai’ian celebration of their freedom. Traditional foods are served, including kalua pig, salmon, and beer. Music and dancing are included. All these things are part of a way of life even further West than the Rocky Mountains.

When Is the Igloo Luau?

We are gathering on Thursday 24 September 2020 in the evening. We plan to have a musical event on Friday evening, perhaps with a band or musical guest of some fame. There will be crafts and games and contests on both Friday and Saturday. Saturday evening will include a luau with roast pig, dancing of all kinds, and music provided by a DJ. There will be a “dead dog” party at noon on Sunday 27 September. After that, you can stay, leave, or jump in the river (there is a river!) because you were always free and sovereign.

Where Is It?

We are currently working to reserve a campground near Bedrock, Colorado and make arrangements for hotel space nearby. We are also working on negotiating deals for overflow space in Naturita, Colorado and possibly in Moab, Utah.

We are eager to include vendors who get two adult passes and 25% off additional passes with space for their wares for $220. Corporate sponsorships are also available.

We want to encourage crafts, so vendors showcasing crafts get an additional discount. We want to encourage musical acts, so if you sing, dance, or wish to speak or otherwise be part of the programme, please be in touch.

We are working with local people on a gun range for Friday and Saturday, afternoon hours only (noon to 5 pm) to avoid being too noisy. We are also working on an archery and tomahawk range for Friday and Saturday. Depending on how these arrangements work out, the range safety team may charge an additional fee.

What If I’m Poor?

We want to help crowd fund the participation of people who have financial difficulties. We’re well aware that 40 million people were thrown out of work by state actions this year, and so if you are struggling to get to the event, or need a fellowship to pay for your costs of participating, we’re very eager to help you set up to get the help you need. As well, we are working to arrange car pools and caravans from different parts of the country, so people can travel to the event together.

Please don’t let your poverty or any other aspect of your situation interfere with being involved. We think this event is going to be the first in a series, but it may be a once in a lifetime opportunity – 2020 is being one of those years where many things happen that seem to change everything.

What Is Gearing Back?

Gearing back is a term from the book 1632 by Eric Flint. Published in 2000, it discusses a time travel event caused by a cosmic art experiment gone wrong. A circle of special energy some miles in circumference takes a community in West Virginia in the 1990s back to the Thuringinwald in 1631. In the novel, the local people develop simpler ways of doing things that still work, knowing that their 20th Century technology has a lot of parts that wear out.

Gearing back means preparing for a future without centralised power systems, or without centralised surveillance systems, or without a huge invasive socialist government encroaching on every aspect of freedom. Some events, like a supervolcano eruption or earthquake or war or Carrington event or electromagnetic pulse can take down large parts of the infrastructure of technological civilisation.

But, remember, our recent ancestors built the technologies we see today. In many cases they built carefully and well, keeping things local, making sure that people knew how to keep things running. Later, especially in the early 20th Century, much effort was made to centralise and, thereby, make fragile all kinds of systems. There was an economic myth of “economies of scale” which were captured by those who ran government-granted monopolies and gave them opportunities to profit greatly. For many reasons, these monopolies are going away.

We think the Igloo Luau is an opportunity to get in touch with older ways of doing things. What if the grocery stores were empty for three or four years? How would you get food? Identify edible things in the wild? Locate edible mushrooms? Make tools? Communicate over long distances? Travel?

People three hundred years ago (1720) had large steam engines, complex hydraulic systems for pumping water, and many scientific methods for working in chemistry, physics, and engineering. Two hundred years ago people had incandescent lighting, gas lighting, and were working on telegraph systems, railways, and steam ships. A hundred years ago, submersible ships, aircraft, high altitude rockets, and radio communications were commonplace, and television was an experiment coming soon.

In gearing back and making robust, decentralised systems available, we have the knowledge of today and a vast array of failed experiments in community building to look at. We can learn and teach from a very different perspective because we know so much more today than we knew then. Including a great deal about what not to do.

It is in that spirit of possibility and discovery that your hosts invite you to attend Igloo Luau 2020.

Festival Time!

On the most recent Little Saigon Report podcast with Dan “Commander Koenig” Sullivan, he and I discussed hosting a festival in Western Colorado we are calling “the Igloo Luau.” We’re still working on details, but if you want to participate, hit me up.

We’ll have a barbecue pig on Saturday night 26 September 2020 which will be “Igloo Luau Hawai’ian Shirt Day” wherever you are. So if you cannot come to Naturita or Bedrock or Paradox or wherever we end up hosting this event, you can participate in solidarity by wearing a Hawai’ian shirt and, if you wish, eating some barbecue pork. And if pork’s not your thing, eat whatever you wish.

We’re thinking that early bird special will be $100 for the whole event, and corporate sponsors can play for $300 each until we get a lot more ambitious and have thousands of people attending (in the third or fourth year, or sooner, who knows?) or until we say the price needs to rise. Your hosts for the show are Dr. Freckles’ Global Tontine Club (DFGTC.ORG), Houston Space Society, and the Resilient Ways Foundation.

Things are likely to kick off Thursday with an evening gathering. People who want to camp will be able to get into the camping area, people will get the special rate at the conference hotel (which is likely to be some distance from the campground), and there will be a reception that evening for those who like to get involved early.

Friday will include events like panel discussions, demonstrations by exhibitors, mountain biking, horseback riding (bring your own or rent nearby), presentations by speakers, and some sort of dance party Friday evening.

Saturday will have more of the same, plus the exhibit spaces will be fully operational so the corporate sponsors can get full value from their involvement. Plus we’ll have some 3D printers on hand if we get a related corporate sponsor, and some other fun activities.

Sunday will be for breaking down tents and hanging out or moving on, plus some sort of “dead dog party” around noon.

There will be meals available, and we’ll have some sort of advanced registration.

Guns Welcome

The nearest metropolitan area of any sort has a city ordinance encouraging people to keep and bear arms. We also plan to have an archery area and if we can make arrangements with suitable range safety, there will be a gun range. Tomahawk training if someone wants to bring those and hold a class.

You are welcome to organise an event during our event and we’ll even help you pimp it to the pre-registered and here on this site. So if you want to speak, or show people how to make something, or if you want to sell stuff, or if you want to be a musical guest, or if you want to be involved any which way, please get in touch.

Burning the Precincts

The American people have been patient for decades while the police murder more and more of us. Last year, the police murdered over a thousand Americans. Police unions are against any form of oversight, any meaningful review of police conduct, and will not tolerate dissent within their ranks. All police are volunteers, none are conscripted. They chose this work, and they chose to cooperate with those police who commit crimes in the name of their fraternal solidarity.

The people in power never have any control except such control as 332 million Americans are willing to provide through patience, some obedience, and limited responses. There are 200 million Americans who live in a home with one or more guns. The government counts “firearms” and claims only 87 million Americans “own firearms” but many guns are not registered with any government, and many guns are not as-defined firearms. I believe there are over 750 million guns in America, and since 3D printed guns have a marginal cost of $8 plus electricity, millions more are on their way.

Tonight, at 01:00 east coast time on Friday 29 May, there are two police precinct buildings in Minneapolis which are on fire, and I gather police retreated from both locations. The people have captured the buildings and have taken possession of all the equipment their tax dollars paid to provide them.

Those in power may ask: How did we lose control?

Quite simple, really. You never had control. We had patience. We were frustrated by the ways you treated Americans, the ways you allowed police to murder us, and we have been outraged by the prison for profit industry that incarcerates millions of Americans and arrests millions more every year. Yet we have been patient.

We’ve been frustrated by the red flag laws and the deaths of people like Duncan Socrates Lemp and Breonna Taylor. We’ve objected to the conduct of police in many specific instances. And we’ve patiently awaited some justice.

George Floyd was a very good man, and beloved of family and community. He was murdered, in cold blood, by a police officer, while other officers stood and watched. And now Minneapolis is on fire. Shots have been fired in Louisville, Kentucky. Protesters have been maced in New York and Los Angeles. Protesters are in other cities, too, facing the police. In all, some 27 cities seem to have active protests going on right now.

My Experiences

My first experience being falsely charged with crimes I did not commit was in 1991. It was not the last. Since then I have been arrested many times, in many states, for various reasons. I’ve never been convicted of a felony. I have been badly beaten by police, including eleven broken bones and a damaged lung on one occasion.

Also, I’ve had the experience of watching the events surrounding the police murder of Philando Castile, Michael Brown, George Floyd, Breonna Taylor, Duncan Lemp, and many, many others.

Some of the readers of this essay will insist that the rioters are always wrong. But, let’s remember that the riots in Los Angeles did not happen until *after* the police officers who beat Rodney King were given a change of venue and then acquitted by a Simi Valley jury. People are patient while there is some reason to believe justice may occur.

Today there is no reason to believe that the system will police the system. The police will investigate the police and the police will exonerate the police. And what are you going to do?

You’ll next want to take me to task because a Target store near the Third Precinct in Minneapolis, where the murderers of George Floyd worked was looted and burned. That store prominently donated to the Third Precinct. I gather there was a longstanding animosity between store management and the local population. But, let’s be clear, if you don’t want your business destroyed, don’t allow your government to let the police your taxes support the murder of men and women in cold blood on camera. Also, keep in mind that the peaceful protests two nights ago were attacked by Minneapolis police.

Mobs are not entities with controls. Expecting a violent mob to be rational is not itself a rational expectation. So, if you don’t like mob violence, do what you can to avoid provoking enough people to form a mob.

Target, AutoZone, Wendy’s and the other businesses were deemed essential while many small businesses were forced to close. That’s unjust, and that’s your government. Employers collect payroll taxes which go to the government after 90 days (yes, they keep that money for a while, how nice) and they collect income tax (sometimes state and local as well as federal). Businesses collect sales tax which funds the city government. And businesses pay lobbyists to get what they want, and apparently what they want is police unions to have ultimate power and police officers to have zero accountability. So, cry me a river about the burned out businesses.

The people in power never had control. They had the patience of the American people. That patience is gone, and it is time for it to stay gone.

Do the people in power want to end these riots? Then they can answer these demands:

  1. All police officers involved in crimes will be arrested and prosecuted to the full extent of the law.
  2. All prison for profit industries will be ended, and all profits from incarceration will be distributed to the taxpayers directly.
  3. Unreasonable bail will end and cruel and unusual punishment will end.
  4. All calls to and from jail will be free of charge at all times. Over a billion dollars profit was made extorting collect call fees from the families of the arrested, and none of the family members were even accused of a crime let alone convicted, so stop punishing them.
  5. Conditions at all jails will be open for inspection every day by local volunteers for humane treatment of prisoners, proper food, access to health care, and decent conditions of imprisonment.
  6. The public defenders are meant to plea bargain convictions, and the prosecutors are paid bonuses for extra convictions. These practices will now end.
  7. All records of all police brutality will be made public and all future police camera recordings (bodycams, dashcams, etc.) will be live streamed to blockchains and publicly available at all times. Those are our cameras, our tax dollars paid for them, and if you want to pretend those are our public servants, let’s see everything they do all the time.
  8. All police unions will be closed and all police pensions will be seized pending investigation of all accusations of crimes by police. Police who are convicted of criminal behaviour will forfeit all their property. Police who do not arrest the police will be fired – knowing of a crime and not arresting the criminal is police foulness and it must end.
  9. Police who are convicted of crimes will be incarcerated with the general population at all times. If the police do not like how they are treated by prisoners, they will reconsider how they treat suspects.

Unless these demands are met, there is no reason to believe that there can be justice.

There can be no peace without justice. There can be no justice without freedom. There can be no freedom without weapons. And until those in power earn our respect, we’re keeping ourselves on high alert. Our patience is gone.
